Welcome to Dahlia Dogs Flower Farm. These Terms and Conditions ("Terms") govern your use of our website and the purchase of products through www.dahliadogs.com
By accessing our site or placing an order, you agree to these Terms. Please read them carefully. We are not responsible for your failure to read these terms prior to your purchase.
1. Products and Availability
We specialize in selling dahlia tubers and products related to flower gardening. Product availability is seasonal and may change without notice. All descriptions and images are provided to the best of our ability, but actual plants may vary in size, colour, and bloom shape due to natural variation and growing conditions.
We reserve the right to discontinue products or adjust pricing at any time.
2. Ordering and Payment
Orders are processed via our website and must be paid in full at checkout. We accept payment in Canadian dollars (CAD) .
It is your responsibility to provide accurate and complete billing and shipping information. Incorrect information may result in order delays or non-delivery, for which we are not responsible.
3. Shipping and Delivery
We ship across Canada during the appropriate planting season for dahlias. Orders are shipped via Canada Post, and delivery times vary depending on your location. All shipments will have a tracking number.
Customers in remote areas may experience longer shipping times. Shipping fees are a flat rate of $25 in Canadian funds.
We are not responsible for delivery delays caused by the carrier, weather, or incorrect shipping details provided by the customer.
4. Viability, Viruses & Incorrect Varieties
Viability Guarantee: We guarantee that our tubers are viable upon delivery. If you receive damaged or non-viable tubers, contact us within 7 days of delivery with clear photos.
Viruses: We practice strict sanitation on our farm throughout the season, from planting in the spring, during the growing season, and again at the time we dig up our tubers in the Fall. We screen for viruses and do not keep or sell anything that appears virused. We cannot, however, guarantee there are no viruses in the product as viruses often take multiple years to appear. Additionally this means something we send you that is healthy may contract something while planted and growing in your garden. We will not be held responsible for how you grow our product in your environment.
No Refunds for Growing Conditions: We do not offer refunds or replacements for issues related to care, weather, or growing failure after planting.
Incorrect Varieties: We are human beings and mistakes can sometimes be made during labelling at the end of the seaon. We utilize multiple tactics to alleviate this. Should you grow a variety from us that you feel is incorrect, we will only issue you a refund or credit if you provide satisfactor photographic evidence, subject to our discretion. We will do our best to rectify the situation where warranted.
5. Intellectual Property
All website content—including images, text, logos, and product descriptions—is the property of Dahlia Dogs Flower Farm and is protected under Canadian intellectual property laws. Unauthorized use or reproduction is prohibited.
6. Limitation of Liability
To the extent permitted by law, Dahlia Dogs Flower Farm is not liable for any indirect, incidental, or consequential damages arising out of or in connection with the use or performance of our products or this website.
This includes (but is not limited to) plant failure, garden damage, allergic reactions, or missed planting seasons.
7. Privacy
We comply with the British Columbia Personal Information Protection Act (PIPA). Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
8. Governing Law
These Terms and your use of our website shall be governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. Updates will be posted to this page, and your continued use of the website signifies your acceptance of the updated Terms.
